All sales are subject to these terms and conditions and no others shall apply.
All orders placed by you on www.hiberniamedical.ie (the “Website”) are subject to these Terms and Conditions. Your acceptance of the delivered goods constitutes a legally binding contract between you and Hibernia Medical Supplies Limited (the “Company”, “we” or “our“).
The processing of your payment and acknowledgement of your order (to include but not limited to sending you an email confirming your order is being processed) shall not constitute legal acceptance of your order.
The price payable for goods is as communicated by our staff over the telephone or by fax and as displayed on our Website at the time you submit your order plus any charges for delivery as advised to you. All prices quoted are subject to VAT at the current prevailing standard rate unless otherwise stated. The Company reserves the right to change prices without prior notice in the event of currency fluctuation and/or manufacturer’s price alterations. Quotations will be current for a period of 30 days unless otherwise stated.
Occasionally, we advertise goods at a promotional price. To avail of promotion prices, you must quote the relevant promotion code. Otherwise, you shall be charged the full price.
If a product’s correct price is higher than our stated price, we will contact you to discuss the higher price with you before dispatch and upon your instruction; we can cancel your order and notify you of such cancellation.
Occasionally, an error may occur, and goods may be either incorrectly priced or described. In these circumstances, the Company will not be obliged to supply the goods at the incorrect price or in accordance with the incorrect description or at all. The Company reserves the right to correct any errors from time to time. We will (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order at the correct price or description. If we are unable to contact you or you do not wish to continue with the order at the correct price or description, we will cancel your order and refund any payment you may have made.
We must receive payment for the full price of the goods you order and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing.

*20% off excludes current specials to include but not limited to sale items, special offers and clearance products. Other exclusions include rentals and selected products. Offer valid for a specified dates or while stocks last. 20% off cannot be used with any offer.

Details, illustrations and specifications in our brochures and Website are correct at time of going to print but may be changed without prior notice.
Risk & Retention of title
All goods supplied remain the Company’s property until payment for goods is received in full, from the customer. The Company accepts no responsibility for misuse or incorrect use of the goods.
Delivery is free on orders over €49 (excluding VAT) and within Republic of Ireland, unless otherwise stated. For product order within Rep of Ireland and below €49 (excluding VAT), a nominal fee of €6.49 exclusive of vat will be charged to cover the costs of our third-party delivery provider. Delivery for large items such as furniture and bulky items will be charged at cost. Carriage will only be charged once per order and the cost includes packaging and insurance.
We aim to dispatch stock items for next day delivery. Next day delivery is only available on items ordered before 12 noon Monday to Thursday. However, delivery times may vary depending upon stock availability at the time of your order and busy periods may require a longer delivery lead time. We deliver from Monday to Friday. We do not deliver on Saturday or Sunday.
We will deliver to the address as you enter it, so please be vigilant when entering delivery address details as we will not accept any liability for late or failed delivery if the quoted address, phone number and other details are incorrect. Please let us know at the time of order if you have restricted access to your practice or if a bulky item requires delivery to an alternate destination.
In instances where an item appears in stock on our Website but is not available for any reason, we will contact you with an alternative item or a full refund can be offered.
We are happy to ship internationally and strive to keep the shipping fast and affordable. Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout. If your delivery address is outside of the EU, it is possible your order may be subject to certain import customs/taxes which are outside of our control. If you are in doubt, please contact your local customs officials. If you have a specific query about a delivery address outside of Ireland/UK or the rest of Europe, please contact us using email@example.com and we will be able to give you a specific delivery quote.
The Company will make every effort to deliver the ordered quantity. Any shortages or claims of shortages must be brought to the Company’s attention in writing within 3 working days. Any claims thereafter shall not be grounds for non-payment of an invoice. Any complaint relating to our failure to deliver the goods invoiced must also be notified to the company in writing within 3 days of the expected delivery date.
Breakages and Restriction of Liability
The Company makes every effort to ensure our products are delivered in perfect condition. The customer must check all goods at the time of delivery, as signature of a consignment note without endorsement may constitute acceptance. If the customer does not check the goods upon receipt, then they must endorse the courier’s consignment note as “unexamined”. Any damages, breakages or shortages must be reported in writing within 3 days of delivery, otherwise no refund claim can be considered after this time.
The Company does not supply goods on a sale or return basis.
No goods will be accepted for credit unless a prior arrangement has been agreed with Hibernia Medical’s returns department. A ‘Goods Return Form’ must be completed for all returns. Orders will only be agreed and accepted for return if goods and packaging are received in good re-saleable condition.
Returned goods are the seller’s responsibility.The Company accepts no responsibility for goods lost or damaged during return transit. We recommend all returns to our offices be done by registered post.
Special order items and Covid related products are are not subject to this returns policy. Additionally, postage and package are non-refundable for special order items.
All promotional offers must be returned in their entirety.
Goods returned after 14 days may incur the following handling charges:
- 15-30 days old 15% of invoice value
- 31-60 days 25% of invoice value
- 60+ days > 25% of invoice value (at Company’s discretion)

All goods are supplied with the product’s manufacturer warranty. The Company gives no warranty and makes no representation as to the suitability or fitness of any goods for a particular purpose unless expressly given or made in such brochures.
Repair of Goods
The Company provides an in-house repair service for out of warranty equipment. An initial inspection fee of €75 (plus VAT) applies, and subsequent repair work is carried out at our standard hourly rates. Parts and carriage are charged at published rates.
Payments shall be made in full 30 (thirty) days after invoice date. All invoices shall include VAT at the rate then in force and other charges applicable. Payment can be made by:

The Company accepts most major credit and debit cards including Laser, Visa, Mastercard, and AMEX.

Late payment may result in interest charges being incurred and/or suspension of credit facilities.
When you use our Website, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, notices and messages on our Website or through other electronic means and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
How to unsubscribe to the Newsletter
There is an unsubscribe link at the bottom of our email newsletters. Alternatively, if you do not want to receive any more marketing communications from the Company, please email email@example.com and we will remove you from our mailing list.
Your Online Account
We take every step to protect your personal information. This includes setting up processes and procedures to minimise unauthorised access to or disclosure of your information. However, we do not guarantee that we will eliminate all risk of misuse of your personal information by unauthorised intruders.
When you create an account on our Website, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and you should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. The Company reserves the right to refuse access to the Website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.
Voucher / Discount codes and coupons
Where a code for discount has been issued, either as a promotional voucher, gift voucher or on a loyalty point scheme, only one voucher code may be used per purchase. Vouchers or coupons may not be exchanged for monetary value and may not be used in conjunction with any other special offers.
